ELIGIBILITY:The AriZona Beverages “AriZona Fruit Snacks” Sweepstakes (the “Sweepstakes”) is open to individual, legal residents of the 50 United States and the District of Columbia, who are 13 years of age and older at time of entry. Employees of Arizona Beverages USA LLC (“Sponsor”), Mpire Creative LLC, distributing retailer(s) of Sponsor and each of their respective parents, successors and assigns, bottlers, subsidiaries and affiliates; employees of advertising, promotion and public relations agencies involved in any way with this Sweepstakes; and members of the immediate family (spouse, parents, siblings and children and their spouses) or persons living within the same household of any of such individuals are not eligible to participate or win a prize. Void outside the United States and where prohibited. By participating, entrants agree to be bound by these Sweepstakes Official Rules.
TO ENTER: The Sweepstakes begins on 8/20/21 and ends on 9/10/21 at 11:59:59 PM ET (the “Promotion Period”). Scan the QR code found at an AriZona Fruit Snacks sampling event. Complete the entry form including your cell phone number and opt in to receive text message updates from AriZona Beverages to receive one (1) entry into the Sweepstakes. Limit: one (1) Entry per person/cell phone. Entry will require an SMS-enabled wireless device. Standard data rates may apply. Check with your wireless service provider for details. By opting in you agree to receive up to six (6) promotional messages per month from or on behalf of Sponsor via an automatic telephone dialing system to the number you provide. To opt out of receiving updates from AriZona Beverages text STOP following the receipt of update message. Participation via text message may not be available from all service providers or in all areas from all service providers. Consent to receive text messages is not a requirement or condition of any purchase. Entries that are generated by a script, macro, or other automated means and/or otherwise not in compliance with these rules will be disqualified. All entries must be received by 11:59:59 PM ET on 9/10/21. Entries become the property of Sponsor.
RANDOM DRAWING/PRIZE: On or about 9/19/21, a random drawing will be conducted by a representative of Sponsor from all eligible entries received to award Grand Prizes: up to a one (1) year supply of AriZona Fruit Snacks and a supply of AriZona beverages as determined by Sponsor (“Prize”). Prize will be awarded in the form of 12 24-2.5oz packages of AriZona Fruit Snacks and 12 24 count cases of AriZona Beverages. Beverage type/flavor and Fruit Snack flavor to be determined by Sponsor. Subject to availability. Additional restrictions may apply. Approximate Retail Value (“ARV”): $500.00. Total ARV of all prizes: $500. Limit: One (1) prize per person/household. Allow eight (8) weeks for shipment of Prize from winner verification date. Upon verification, Prize will be awarded to the natural owner of the cell phone account used to enter the Sweepstakes. Odds of winning will be determined by the number of eligible Entries received. Texting by proxy on behalf on another individual is not permitted. Winner will be contacted by a representative of Sponsor by voice call or text message using the cell phone number to enter the Sweepstakes. Sponsor may send a text message and require potential winner to respond via text or send an email to Sponsor’s designated email address as provided by Sponsor to claim Prize. Winner will be required respond to Sponsor within 24 hours of notification accepting the Prize and will be required to supply a valid, U.S. shipping address (no P.O. Boxes) prior to shipment of Prize. If Sponsor does not receive a reply message from potential winner within specified time, prize may be forfeited and may be awarded to an alternate. Potential Prize winner may be required to demonstrate control of the phone number associated with a winning Entry. Potential winner may be required to sign an Affidavit of eligibility, liability release and (where lawful) a publicity release. Noncompliance by date specified, or return of documents or any Prize or Prize notification as undeliverable, will result in disqualification. Sponsor is not responsible for any change of mailing address, email address, and/or telephone number of entrants. Unclaimed or undeliverable prize may not be awarded.Prize pictured in advertising materials is for creative display only. Actual Prize may vary from that depicted in advertising materials.
PRIZE RESTRICTIONS:No substitution, assignment or transfer of Prize permitted by winner. Prize cannot be redeemed for cash, but Sponsor reserves the right to substitute a prize of comparable or greater value, at its sole discretion if an advertised prize becomes unavailable. If a winner is a minor in his/her jurisdiction of residence, prize may be awarded in the name of, or to, winner’s parent/legal guardian who must execute all documents and agree to all obligations and undertakings of winner, both on behalf of himself/herself and winner. All federal, state and local taxes and any other costs and expenses associated with the acceptance and use of the Prize not specified herein are the sole responsibility of each winner.
GENERAL CONDITIONS: Winner (and winner’s parent/legal guardian, if winner is a minor), by acceptance of Prize, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name and/or photograph, post(s) on social media websites, voice and/or likeness for advertising, trade and promotional purposes without further compensation, at any times or time, in all media now known or hereafter discovered worldwide and on the Internet without notice or review or approval. By participating in the Sweepstakes and/or accepting a Prize, Sweepstakes entrants agree to: (a) be bound by these official rules and the decisions of the Sponsor, which shall be final and binding in all respects; and (b) to release and forever discharge and covenant not to sue Sponsor, Administrator, Mpire Creative LLC, and each of their respective parent companies, affiliates, subsidiaries, distributors, agents and promotion and advertising agencies, and the employees, directors and officers of each of the foregoing entities (“Released Parties”), from any and all claims, demands, damages, losses and liabilities, of any nature whatsoever, which they may now or hereafter assert, including but not limited to, claims for injury, death, damages, or illness arising out of or relating to or claimed to be arising out of or relating to Sweepstakes Entry, prize acceptance, preparing for or travelling to any prize-related activity, or use or misuse of the Prize or any product or prize certificate awarded including, without limitation, personal injury, death and property damage. Sponsor and its agents are not responsible for any printing or other errors in Sweepstakes-related material. Released Parties are not responsible for computer system, WIFI, phone line, hardware, software or program malfunctions, or other errors, failures or delays in phone or computer transmissions or network connections that are human or technical in nature and may limit ability to participate, or for lost, late, damaged, incomplete, inaccurate, delayed, misdirected, Entries, and all such entries will be void. Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes and select the potential winner from all eligible, non-suspect Entries received prior to such action. CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY, PROSECUTE AND SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right to disqualify permanently from this Sweepstakes any entrant it believes has violated these Official Rules. If it is suspected that the same individual enters the Sweepstakes using multiple phone numbers in an attempt to gain additional entries beyond the Entry limits stated in these Official Rules, Sponsor reserves the right to disqualify such individual and all Entries will be void.
GOVERNING LAW & JURISDICTION:This Sweepstakes will be governed by the laws of the State of New York. All issues and questions concerning the construction, validity, interpretation and enforceability of the Sweepstakes, and/or the rights and obligations of entrants and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to the conflict of laws rules thereof. Entrants consent to jurisdiction and venue in the federal and state courts located in Nassau County, New York, and agree that any claims or disputes shall be resolved exclusively in those courts.
