NO PURCHASE NECESSARY TO ENTER OR CLAIM PRIZE. A purchase will not improve your odds of winning. SWEEPSTAKES INTENDED FOR VIEWING AND PLAY IN THE FIFTY (50) UNITED STATES ONLY.

ELIGIBILITY:The AriZona Beverages “AriZona Exclusives” Sweepstakes (the “Sweepstakes”) is open to individual, legal residents of the 50 United States and the District of Columbia, 13 years of age and older at time of entry. Employees of Arizona Beverages USA LLC (“Sponsor”), Mpire Creative LLC, distributing retailer(s) of Sponsor and each of their respective parents, successors and assigns, bottlers, subsidiaries and affiliates; employees of advertising, promotion and public relations agencies involved in any way with this Sweepstakes; and members of the immediate family (spouse, parents, siblings and children and their spouses) or persons living within the same household of any of such individuals are not eligible to participate or win a prize. Void outside the United States and where prohibited. By participating, entrants agree to be bound by these Sweepstakes Official Rules and the decisions of the Sponsor which are final and binding in all matters relating to this Sweepstakes.

TO ENTER: The Sweepstakes will execute weekly beginning on Monday 11/9/20 and ending the following Sunday at 11:59:59 PM ET (each a “Promotion Period”). A new Promotion Period will begin each following Monday until Sponsor decides to discontinue which will be communicated on Instagram @drinkarizona. For the purposes of this Sweepstakes, a Promotion Period is defined as a Monday beginning at 10:00:01 AM ET and ending the following Sunday 11:59:59 PM ET. The Sponsor’s computer will be the official time keeping device for this Sweepstakes. You must be following @drinkarizona on Instagram to enter. To enter, click the link found on the @drinkarizona Instagram page or visit https://drinkarizona.com/pages/weekly-giveaway. Follow the instructions to sign up to receive the AriZona Exclusives Newsletter by email and click submit to gain one (1) entry into the Sweepstakes (an “Entry”). Limit: one (1) Entry per person/email address per Promotion Period. You may sign up for an account at Instagram.com for free and follow @drinkarizona. To enter using a mobile or wireless device, internet access (data package) or WiFi is required. Standard data rates may apply. Check with your wireless service provider for details. Entries that are generated by a script, macro, or other automated means and/or otherwise not in compliance with these rules will be disqualified. Entries become the property of Sponsor. RANDOM WEEKLY DRAWING/PRIZE: Beginning on or about 11/16/20 and each subsequent Monday, a random drawing will be conducted by a representative of Sponsor from all eligible Entries received for each Promotion Period to award One (1) Weekly Prize: AriZona merchandise as specified by Sponsor (“Prize”). Approximate Retail Value (“ARV”): $50.00 each Prize. Allow eight (8) weeks for shipment of Prize from winner verification date. Prize will be awarded to the natural owner of the email account as determined by winner’s internet service provider (ISP) upon verification. Odds of winning will be determined by the number of eligible Entries received during each Promotion Period. Non-winning Entries will not carry forward to subsequent drawings. All prizes will be awarded presuming a sufficient number of eligible Entries are received for each Promotion Period and Prizes are properly claimed. Submission of an Entry on behalf of another individual is not permitted. Winner(s) will be notified by Sponsor at the email address supplied during the entry process. Potential winner(s) will be required respond to Sponsor within 48 hours of notification accepting the Prize and will be required to supply a valid, U.S. shipping address (no P.O. Boxes) prior to shipment of Prize. If Sponsor does not receive a reply message from potential winner within specified time, Prize may be forfeited and may be awarded to an alternate. Potential winner may be required to sign an Affidavit of eligibility, liability release and (where lawful) a publicity release as well as execute an IRS Form W9. Noncompliance by date specified, or return of documents or any Prize or Prize notification as undeliverable, will result in disqualification. Sponsor is not responsible for any change of mailing address, email address, and/or telephone number of entrants. Unclaimed or undeliverable Prize may not be awarded. Limit: one (1) Prize per person. Sponsor does not make, nor in any manner is responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to Prize including but not limited to its quality, fitness for purpose and/or mechanical condition. Images shown in any promotional materials are for illustration purposes only; actual prize merchandise awarded may vary from that depicted in advertising materials.

PRIZE RESTRICTIONS:No substitution, assignment or transfer of Prize permitted by winner. Sponsor reserves the right to substitute a Prize of comparable or greater value, at its sole discretion if an advertised prize becomes unavailable. If a winner is a minor in his/her jurisdiction of residence, prize may be awarded in the name of, or to, winner’s parent/legal guardian who must execute all documents and agree to all obligations and undertakings of winner, both on behalf of himself/herself and winner. All federal, state and local taxes, if any and any other costs and expenses associated with the acceptance and use of the Prize not specified herein are the sole responsibility of the winner.

GENERAL CONDITIONS: Winner (and winner’s parent/legal guardian, if winner is a minor), by acceptance of Prize, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name and/or photograph, post(s) on social media websites, voice and/or likeness for advertising, trade and promotional purposes without further compensation, at any times or time, in all media now known or hereafter discovered worldwide and on the Internet without notice or review or approval. By participating in the Sweepstakes and/or accepting a Prize, Sweepstakes entrants agree to: (a) be bound by these official rules and the decisions of the Sponsor, which shall be final and binding in all respects; and (b) to release and forever discharge and covenant not to sue Sponsor, Administrator, Mpire Creative LLC, and each of their respective parent companies, affiliates, subsidiaries, distributors, agents and promotion and advertising agencies, and the employees, directors and officers of each of the foregoing entities (“Released Parties”), from any and all claims, demands, damages, losses and liabilities, of any nature whatsoever, which they may now or hereafter assert, including but not limited to, claims for injury, death, damages, or illness arising out of or relating to or claimed to be arising out of or relating to Sweepstakes Entry, prize acceptance, preparing for or travelling to any prize-related activity, or use or misuse of the Prize or any product or prize certificate awarded including, without limitation, personal injury, death and property damage. Sponsor and its agents are not responsible for any printing, communication or other errors in Sweepstakes-related material. Released Parties are not responsible for computer system, WIFI, phone line, hardware, software or program malfunctions, or other errors, failures or delays in phone or computer transmissions or network connections that are human or technical in nature and may limit ability to participate, or for lost, late, damaged, incomplete, inaccurate, delayed or misdirected Entries; and all such Entries will be void. Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes and select the potential winner from all eligible, non-suspect Entries received prior to such action. All decisions of the Sponsor are final.

GOVERNING LAW & JURISDICTION:CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY, PROSECUTE AND SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. By entering, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate courts located in the State of New York; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes (if any) but in no event attorneys’ fees; and (c) to the extent allowed by applicable law, under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York. Entrants consent to jurisdiction and venue in the federal and state courts located in Nassau County, New York, and agree that any claims or disputes shall be resolved exclusively in those courts. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, the Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials and the terms and conditions of these Official Rules, the Official Rules shall prevail, govern and control.
